David Gauthier is one of the most outstanding and influential philosophers working in moral theory today, and his book Morals by Agreement has established him as a preeminent defender of contractarian moral theory. This volume brings together a selection of his best essays on contractarianism, many of which have become difficult to find.

Is morality rational? In this book Gauthier argues that moral principles are principles of rational choice. He proposes a principle whereby choice is made on an agreed basis of cooperation, rather than according to what would give an individual the greatest expectation of value. He shows that such a principle not only ensures mutual benefit and fairness, thus satisfying the standards of morality, but also that each person may actually expect greater utility by adhering to morality, even though the choice (...) did not have that end primarily in view. In resolving what may appear to be a paradox, the author establishes morals on the firm foundation of reason. Gauthier's argument includes an account of value, linking it to preference and utility; a discussion of the curcumstances in which morality is unnecessary; and an application of morals by agreement to relations between peoples at different levels of development and different generations. Finally, he reflects on the assumptions about individuality and community made by his account of rationality and morality. (shrink)

The principle of alternate possibilities (PAP), making the ability to do otherwise a necessary condition for moral responsibility, is supposed by Harry Frankfurt, John Fischer, and others to succumb to a peculiar kind of counterexample. The paper reviews the main problems with the counterexample that have surfaced over the years, and shows how most can be addressed within the terms of the current debate. But one problem seems ineliminable: because Frankfurt''s example relies on a counterfactual intervener to preclude alternatives to (...) the person''s action, it is not possible for it to preclude all alternatives (intervention that is contingent upon a trigger cannot bring it about that the trigger never occurred). This makes it possible for the determined PAPist to maintain that some pre-intervention deviation is always available to ground moral responsibility. In reply, the critic of PAP can examine all the candidate deviations and argue their irrelevance to moral responsibility (a daunting prospect); or the critic can dispense with counterfactual intervention altogether. The paper pursues the second of these strategies, developing three examples of noncounterfactual intervention in which (i) the agent has no alternatives (and a fortiori no morally relevant alternatives), yet (ii) there is just as much reason to think that the agent is morally responsible as there was in Frankfurt''s original example. The new counterexamples do suffer from one liability, but this is insufficient in the end to repair PAP''s conceptual connection between moral responsibility and alternate possibilities. (shrink)

Dramatic changes or revolutions in a field of science are often made by outsiders or 'trespassers,' who are not limited by the established, 'expert' approaches. Each essay in this diverse collection shows the fruits of intellectual trespassing and poaching among fields such as economics, Kantian ethics, Platonic philosophy, category theory, double-entry accounting, arbitrage, algebraic logic, series-parallel duality, and financial arithmetic.

Dramatic events involving dangerous microbes often focus attention on isolation and quarantine as policy instruments. The incident in May-June 2007 involving Andrew Speaker and drug-resistant tuberculosis joins other communicable disease crises that have forced contemplation or actual application of quarantine powers. Implementation of quarantine powers, which encompasses authority for both isolation and quarantine actions, is important not only for the handling of a specific event but also because the use of such authority provides a window on broader issues of public (...) health and the legal rules, ethical principles, and governance systems that support it. Debates about quarantine powers reflect political and social attitudes about public health that often tell us more about this policy endeavor than acts of isolation and quarantine themselves. The Logic of Leviathan The Moral and Political Theory of Thomas Hobbes.

The goal of this paper is to stress the significance of ethics for engineering education and to illustrate how it can be brought into the mainstream of higher education in a natural way that is integrated with the teaching objectives of enriching the core meaning of engineering. Everyone will agree that the practicing engineer should be virtuous, should be a good colleague, and should use professional understanding for the common good. But these injunctions to virtue do not reach closely enough (...) the ethic of the engineer as engineer, as someone acting in a uniquely engineering situation, and it is to such conditions that I wish to speak through a set of specific examples from recent history. I shall briefly refer to four controversies between engineers. Then, in some detail I shall narrate three historical cases that directly involve the actions of one engineer, and finally I would like to address some common contemporary issues. The first section, “Engineering Ethics and the History of Innovation” includes four cases involving professional controversy. Each controversy sets two people against each other in disputes over who invented the telegraph, the radio, the automobile, and the airplane. In each dispute, it is possible to identify ethical and unethical behavior or ambiguous ethical behavior that serves as a basis for educational discussion. The first two historical cases described in “Crises and the Engineer” involve the primary closure dam systems in the Netherlands, each one the result of the actions of one engineer. The third tells of an American engineer who took his political boss, a big city mayor, to court over the illegal use of a watershed. The challenges these engineers faced required, in the deepest sense, a commitment to ethical behavior that is unique to engineering and instructive to our students. Finally, the cases in “Professors and Comparative Critical Analysis” illuminate the behavior of engineers in the design of structures and also how professors can make public criticisms of designs that seem wasteful. In this paper we will discuss the issue of environmental advocacy in science education in light of William Hare’s concept of open-mindedness. Although we shall assume that science teaching and learning must go beyond the scientific facts and theories and deal with the implications of science for society, we shall argue that science education should also demand an open-mindedness about environmental concerns such that all proposals for sustainability and the like are weighed against the alternatives using the best scientific knowledge (...) available. Our approach will be to describe two examples of environmental education that recommend insufficiently open-minded forms of teaching and a third example that avoids this shortcoming yet provides a sound basis in environmental education. This study uses a “science pipeline” model and cross-national data to examine women's participation in science education and occupations in seven countries. Gender stratification in later science education and in science occupations is found in every country examined. Young women's participation in science education decreases with each stage in the science pipeline, but there is considerable cross-national variation in the extent of gender stratification in science. Findings show greater gender stratification in science occupations than in science education, suggesting factors other (...) than training help maintain inequality in high-status science occupations. The incident in May-June 2007 involving a U.S. citizen traveling internationally while infected with drug-resistant tuberculosis involved the U.S. federal government's application of its quarantine and isolation powers. The incident and the isolation order raised numerous important issues for public health governance, law, and ethics. This article explores many of these issues by examining how the exercise of quarantine powers provides a powerful lens through which to understand how societies respond to and attempt to govern threats posed by dangerous, contagious (...) pathogens. The article considers historical aspects of governmental power to quarantine and isolate individuals and groups; analyzes the current state of quarantine and isolation law in the United States in light of the recent incident with drug-resistant tuberculosis; and explores global aspects of public health governance and law highlighted by this incident. What is the root cause of ethical failure? Why is preoccupation with ethics more a part of the problem than a part of the solution? What makes ethical conduct a natural expression of who we are? What enables us to be ourselves in our relations with others? Ethical failure has become a significant concern in public life, in organizations and in educational institutions. The Capacity for Ethical Conduct explores how qualities of character and personality either make ethical conduct possible for (...) the individual or foster ethical failure. David Levine discusses how ethical conduct is a special way of relating to others, one that secures respect for their integrity by assuring that what they do can express who they are. He argues that this special way of relating to others results not from knowledge of, or a stated commitment to, rules, norms and values, but from the way we experience ourselves, especially from our ability to make a positive emotional investment in being and having a self. Traditionally, emphasis on the importance of values and ethics in shaping conduct tends to be connected to the need to find fault in self and others, fostering an atmosphere where the self is put at risk in its relations to others. This means that an excessive emphasis on ethics, rather than assuring ethical conduct, tends instead to create interpersonal settings marked by emotional assault. Because of this, talk about ethics often expresses ambivalence about ethical conduct, which makes the familiar combination of preoccupation with ethics and ethical failure unsurprising. The Capacity for Ethical Conduct explores the ways in which the interpersonal world of work either fosters a feeling of safety or encourages various forms of emotional assault. Presenting case studes and applying psychoanalytic object relation theory and self psychology, this book explores the factors underlying ethical failure and the capacity for ethical conduct. I will discuss the history and prospects for new machines and instruments as anticipated in the newly announced EU Flagship for Quantum Technology. The program of Richard Feynman, as announced almost 60 years ago, to go to the “bottom” in the miniaturization of information-processing technology, has come to fruition, and a set of well-defined technologies, in the areas of quantum computing, quantum simulation, quantum sensing and metrology, and quantum communication, have emerged. I give a perspective on the sometimes abstruse significance (...) of these coming technologies. The scientists will continue beyond these technologies to new unfoldings of quantum knowledge, whose technological significance we can barely fathom today. (shrink)

This SCE presidential address attempts an interpretation of the history of American Christian ethics that is simultaneously an intellectual autobiography. Seven types of Christian ethics receive attention: ecclesial-formational, Protestant social ethics, Niebuhrian, Catholic, evangelical, Hauerwasian, and liberationist. The discipline is described as methodologically fractured and professionally endangered, especially in the case of its founding strand, Protestant social ethics. The article titled The pearl of the ‘Pro-Life’ movement? Reflections on the Kermit Gosnell controversy is a thoughtful piece in which the author raises some important questions, including those impinging on the motivations and apparent inconsistencies of the more vocal officials of the more visible segments of a vast and somewhat diverse grass-roots social uprising.1The pro-life movement has indeed showcased the Gosnell trial, but not because many of its members actually believe that gestational age is a morally relevant criterion. In (...) fact, there is probably a nearly uniform desideratum among the most influential groups to abolish all induced abortion from the first moment of conception, even if that goal logically also requires a ban on all potentially abortifacient contraceptives .2 Even the umbrella National Right to Life Committee with its 50 state affiliates, many of which have been criticised for their incremental approach to ending elective abortion,3 holds that ‘a new individual human being begins at fertilisation, when the sperm and ovum meet to form a single cell.’4 There is no practical necessity to split temporal or geographical hairs about when or how far the sperm must enter the ovum for formal union to occur, because the process is virtually inexorable once it starts, and is, thence, confined to a short span of time and space.Nor are the pro-life leaders being ‘disingenuous’ in their focal interest on this particular case. This essay analyzes the theological need for a theory of doctrinal development, the failure of Newman's via media project, and his role as a creative theologian. Then this essay examines in detailed Newman's 1845 Essay on the Development of Christian Doctrine, looking specifically at (...) the second section of the second chapter, ‘On the Probability of a Developing Authority in Christianity.’ The main body of the paper treats the expansion of the scope and feasibility of infallibility in Newman's 1845 Essay. It has recently been shown that stem and progenitor cells undergo population self‐renewal to maintain epithelial homeostasis. The fate of individual cells is stochastic but the production of proliferating and differentiating cells is balanced across the population. This new paradigm, originating in mouse epidermis and since extended to mouse oesophagus and mouse and Drosophila intestine, is in contrast to the long held model of epithelial maintenance by exclusively asymmetric division of stem cells. Recent lineage tracing studies have now shown that (...) wound responses vary between tissues, and that a stem cell reserve is not essential as cycling progenitors and even differentiating cells contribute to regeneration. Consider an election in which each of the n voters casts a vote consisting of a strict preference ranking of the three candidates A, B, and C. In the limit as n→∞, which scoring rule maximizes, under the assumption of Impartial Anonymous Culture (uniform probability distribution over profiles), the probability that the Condorcet candidate wins the election, given that a Condorcet candidate exists? We produce an analytic solution, which is not the Borda Count. Two contemporary strategies in cadaver organ transplantation, both with the potential to affect significantly expanding organ transplant waiting list sizes, have evolved: elective ventilation and use of nonheart-beating donors. Both are undergoing a period of critical review. It is not clear how widely EV is practiced around the world. In Great Britain, the Royal Devon and Exeter Hospital was the first hospital to develop an EV protocol, in 1988, after which other British hospitals followed suit. In the 1980s, new NHBD (...) protocols of two distinct types were implemented worldwide, although both rely on death confirmed by traditional cardiopulmonary criteria. The first type involves the removal of organs immediately after death, the preeminent example being the University of Pittsburgh Medical Center Protocol. The second involves the perfusion and cooling of kidneys immediately following death and subsequent organ removal. Protocols of this type have sprung up in Holland, Great Britain, Italy, France, Spain, Japan, and the United States. (shrink)

Improvisation gilt genreübergreifend als Charakteristikum von Jazzmusik, dessen Struktur zu verstehen eine zentrale Aufgabe der philosophischen Beschäftigung mit Jazz als künstlerischer Praxis ist. In diesem Beitrag analysiere ich, unter Verwendung grundlegender handlungstheoretischer Begriffe, insbesondere die Struktur der Interaktion zwischen gemeinsam Musizierenden. Ich argumentiere dafür, dass Interaktion bei Soloimprovisation ebenso eine Rolle spielt wie in verschiedenen Formen gemeinsamen Improvisierens und des Ensemblespiels. Damit wird ein Zugriff auf die Praxis der Jazzmusik entwickelt.

FürSolidarität die Politische Philosophie und die Politische Ethik sind Analysen praktischer Haltungen und sozialer Praktiken besonders dann interessant, wenn sie auf Gemeinschaft konstituierende Merkmale verweisen und mit der Überwindung von gesellschaftlichen Spannungen oder Konflikten in Verbindung gebracht werden. Toleranz und Solidarität werden als solche praktische Haltungen zur Herausforderung für die philosophische Reflexion, insofern Akteur:innen diese Haltungen angesichts weitreichender Unterschiede oder Gemeinsamkeiten zwischen Lebensentwürfen und Grundüberzeugungen einnehmen. Allerdings wird in der Reflexion über diese Haltungen ihr Vorliegen nicht nur konstatiert, sondern sie (...) werden unter bestimmten Voraussetzungen als moralisch gefordert, als Bezeichnung für Tugenden von Bürgern und politischen Praktiken oder als Vorzug eines politischen Gemeinwesens angesehen.
